Illegal Drug Business Flourishes in Mongolia
It has been many years since individuals and companies illegally import large quantity of drugs and medicines to the country and a new type of campaign to confiscate and eliminate such drugs and medicines has become a normal activity for authorities. Officials claim that the most of eliminated drugs are not registered to national drug registration or are counterfeit ones. The World Health Organization warns that fake drug is active circulation at world market in large quantity. WHO says many African countries and in parts of Asia, Latin America has a much higher percentage of the counterfeit medications on sale.
More clearly, counterfeit drugs are mostly sold in poor countries where regulatory and enforcement systems for medicines are weakest.
According to WHO statistics, 10 percent of medications on world market is counterfeit and do not meet quality requirements. Besides, Mongolia is sandwiched between Russia and China, the top two economies in the world according to production and sale of fake drugs, from where fake drugs are flowing in large quantities. China and India are the first two leaders in fake drug production, followed by Russia, a survey by international organization shows.
Such fake drugs are brought to Mongolia by peddlers through trains and trucks loaded with woodstuff. Drug stores and retail sellers from black markets make good profit by purchasing such illegally imported drugs cheaper and re-selling them to end consumer at higher price.
Governments of India and China are said to have not taken decisive actions to stop production and exporting of fake drugs. Russia annually supplies US$300 million worth fake medications to market products and this number is increasing.
A web portal says that China sells fake drugs to world market through Egypt and that counterfeit drugs made in India and China claim thousands of lives in the world.
It mentions that they make medications by using earth, chalks and raw water, and distribute all around the world. The most of fake drugs coming to Mongolia is not registered properly. Thanks to intensive controlling and inspecting actions conducted in last three years, a number of crimes related to importing and selling of fake drugs were disclosed by law enforcement agencies.
Economic Crime Unit at the Criminal Police Department jointly with the Selenge Province Police Station carried a special operation and stopped ten attempts to traffic fake drugs through a border check point in the province. At the present, Criminal cases are initiated against theses cases and are under investigation.
Besides, separate criminal cases were initiated against owners of nine foreign-run hospitals and await court trial respectively.
Recent years, our youth and teens tend to get addicted to narcotic and psychotropic drugs. Though several celebrities from music industry were sentenced for illegal acquiring, storing, selling and consuming narcotics, such crime continue to exist. Few years ago the teens would use shoe polish and glues to get intoxicated, now they are addicted to various liquefied gas of household purpose and various depressants.
Even there was a case that a teen killed a person to get a psychotics substance.
To be clear, three or four years ago, a pharmacist was killed in his drugstore in a district of Ulaanbaatar City and the killer took cashes and morphine away. Mongolia’s law to control the circulation of narcotic drugs and psychotropic substances states that medications, natural and synthesized preparations that seduce addiction and exert strong affect to psychics listed in the 1961 UN Single Convention on Narcotic Drugs and in the 1971 UN Convention on Psychotropic Substances and that should be under strict control of the country, shall be regarded as narcotic drugs and psychotropic substances.
Drugs and preparations like morphine and sedatives used for medical treatment as pain reliever are included in the list of narcotic substances according to the UN Conventions.
Such drugs and preparations are granted in small amount based on only doctor’s prescription. Unfortunately, this legal provision is not implemented in reality and it can be said that anyone wishes buy narcotic and psychotropic drugs from drug stores.
Pursuant to Chapter 5, Law to Control Circulation of Narcotic Drugs and Psychotropic Substances, the narcotic and psychotropic drugs to be used for medical purpose must be granted based on special prescription of doctor.
The law also rules that a soum or district must have only one drug store licensed to serve with narcotic and psychotropic drugs, in their territory and their location must be health body of the province and capital city.
Accordingly, there are only few business entities in Ulaanbaatar City licensed by the Metropolitan Health Department to sell narcotic and psychotropic drugs.
A recent police raid revealed that almost every drugstore in the city sold narcotic drug called ‘sedatives’ violating the above law provision.
It is reported that separate criminal cases were initiated against owners of the pharmacy shops and investigation is ongoing. However, the police are not willing to talks about this matter openly.
According to information we have, one of the biggest drug suppliers of Mongolia apparently imported sedatives in large quantity and illegally distributed them around all drug stores in the city.
In connection with the case, top officials of that company is being investigated by the police.
Criminal Cases Initiated Against Owners of Nine Foreign-Run Hospitals
The Crime Police Department’s Unit of Economic Crime (ECU) last three years investigates all crimes relevant to illegal drug circulation and illegal medical undertakings. Since then, ECU initiated and investigated criminal cases against owners of nine foreign hospitals that run illegal medical service to Mongolians last year only.
According to Mayor Amgalan, ECU chief, 80 percent of the hospitals had no related special licenses, the drugs and preparations they used for treatment were not tested and certified by competent professional bodies, had not customs registration and had no quality or description certificates.
The information available shows that foreign-invested hospitals such as “Beijing Ankan”, “Otoch Ima” and “Shuren Tana Medical” operated in our country illegally. They explained their illegal undertaking that “Your Health Ministry and Professional Inspection Agency are very bureaucratic and has very slow service. That’s why we could not get licenses. We cannot live up to see licenses in our hands”.
On the one side, it is a fault of people who run illegal treatment, but on the other side, it is not deniable that the bureaucracy in our public service forced them to such illegal way.
These hospitals served our citizens with drugs and preparations, which are not certified and which do not meet standard requirements. It is a requirement that all medications certified in national drug registration, must enclose instructions in English, Russian and Mongolian languages.
But these hospitals’ stockrooms were full with medications with unclear designation, effects and expiry date and instructions were in Chinese kanji.
It is not clear how such a large amount of uncertified drugs crossed the border and customs control.
Some of them say they brought illegal drugs by hiding them under other goods and some say by using their links in customs.
The most dangerous thing is that they inject such drugs and substances into human veins. What are our citizens thinking while they are injected by such drugs with unclear designations and effects? Besides, they say that we don’t have modern laboratory and equipment to test some medications.
It is not inestimable how dangerous these drugs can be to human genetic fund and health after many years even though there is no negative affect today.
In addition, some medications do not yield expected results because of reduced size and compound regardless of the fact they are certified properly.
Such certified but bad medications manage cross border because of bad law on tender bidding. It is a requirement of a tender bid that the lowest price is offered for particular goods. An investigation disclosed that the companies licensed to import medications either make fake drugs or supply cheaper and smaller drugs from a branch or small factories of a prestigious drug manufacturer. Because the illegal drug circulation flourishes in Mongolia, there is an increasing potential threat to Mongolian genetic fund if the authorities will not strengthen their co-ordination, modernize their equipment and tools and improve related legal framework.
