Necessary Hurdles to Complete Parliament

The Parliament has been working with 71 members for the past several months. The Parliament is missing in Songinokhairkhan and the Bayanzurkh district’s representation and both of N.Tumurkhuu and S.Chinzorig have already been chosen and issued a temporary membership due the opposition party accusing them of breaking the law and distributing cash to the elector’s hands—which has been filed in court. The other two districts have one seat in the parliament and the candidates have not been able to gain 28 percent of the vote so it must vote again. The court will make decision as to who shall represent the Uvurkhangai province. The local court need to determine whether the candidates broke the election law. D.Zorigt lodged a complaint that the candidate distributed vodka and funds to attract the elector’s vote and this issue was under the control of the Khan-Uul district. The court has made a decision that candidates of Mongolian People’s Party broke a law, but the candidates have appealed this decision claiming that this issue was not decided within the proper jurisdiction whereas the Metropolitan Court responded that this must be decided in the local courts. Candidates of the Democratic Party have opposed the resolution, turning to the High Court of Justice. During this period the local court has decided that the candidates of the Mongolian People’s Party have indeed broken the law. Members of the Democrat Party, G.Batkhuu and D.Zorigt, received their application back from the High Court. Whatever the local court’s decision is, it shall be delivered to general election committee and will be discussed. Uvurkhangai’s voters will not have representation in Parliament if the candidates of the Mongolian People’s Party appeal the court. The seats of two districts will be on the agenda for discussions on the local election on October 21. Both candidates of the Bayanzurkh district, who are members of the Mongolian People’s Party, will be included in the topic of discussions. The Songinokhairhan district’s parliamentary representation is in doubt but there are two candidates vying for the seats which are D.Sumyabazar from the Mongolian People’s Party and L.Erkhembayar from the Democratic Party. There has been hesitation regarding two resolutions: 43 and 48. Baasandorj who is the head of the electoral district in the Songinokhairhan in Ulaanbaatar said that the 43th resolution is official and was sent to general election committee. Yet the 48th resolution was not signed by the head of electoral district and secretary signed in that person’s place. The candidates of the Democratic Party issued their invoice to the administrative court. The General election committee has officially announced the arrival of 48th resolution, but the court will control and determine this issue. It is unclear if it is necessary to hold a re-vote. The official result to gain the vote between the two candidates is up to the voters to decide. Before the 21th of this month, to solve these pending issues, we will receive a new member of parliament, who will be the 71st and 72nd members. There is one member who cannot be guaranteed in his authority, candidate Ts.Oyunbaatar who was chosen by list from MPRP. E.Batshugar has became a vice minister of Mongol bank and must take an oath. With the final results, the parliament will be composed of 76 members in this month.
